Please read these Terms and Agreements carefully before using LoveLensGallery. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Who We Are

LoveLensGallery is operated by IMGUPSCL SOFTWARE SRL, a company registered in Romania under CUI 44391555, registration number J20/852/2021, with registered office at str. Mihai Eminescu, nr. 97, bl. C1, ap. 24, Deva, Hunedoara, Romania.

2. Description of the Service

LoveLensGallery is a cloud-based photo and video sharing platform designed for weddings and events. Registered users (event organisers) generate a QR code for their event; wedding guests scan the QR code to upload photos and videos without needing to create an account. Registered users can browse their private gallery, apply optional face-recognition filters to find photos of specific people, and share their memories.

3. User Accounts

To create an event and manage your gallery, you must register an account using a valid email address or a Google account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You must be at least 18 years old to register an account. By registering, you confirm that all information you provide is accurate and up to date.

4. Subscription Plans

Free Trial: New accounts include a free trial that allows up to 20 photo or video uploads per event. No payment is required for the trial.

Paid Plan: To unlock unlimited uploads for your event, a one-time payment is required. Pricing is displayed at checkout in the currency applicable to your country (RON for Romania, EUR for EU countries, USD elsewhere). Your event is immediately upgraded after successful payment.

5. Payment and Invoicing

Payments are processed securely by Stripe. We do not store your payment card details. By completing a purchase, you authorise us to charge the amount displayed at checkout.

You will receive an invoice by email after payment. For customers in Romania, invoicing is handled through Oblio. For EU customers outside Romania, invoicing is handled through Qonto. Please ensure your billing information is correct before completing your purchase, as invoices cannot be reissued once generated.

6. Refund Policy

LoveLensGallery provides a digital service that is immediately activated upon payment. Because the service is fully delivered at the moment of upgrade, refunds are generally not available once the paid plan has been activated.

If you experience a technical issue that prevents you from accessing the paid features, please contact us within 14 days at contact@lovelensgallery.com and we will assess your situation. Refund requests for duplicate charges or incorrect billing will be honoured in full.

7. Content Uploaded by Users

You retain full ownership of all photos and videos uploaded to LoveLensGallery by you or your guests. By uploading content, you grant LoveLensGallery a limited, non-exclusive, worldwide licence to store, process, and display your content solely for the purpose of providing the Service to you.

You are responsible for ensuring that all content uploaded through your event QR code complies with applicable law. You must not use the Service to upload content that is illegal, infringes third-party intellectual property rights, is defamatory, or is otherwise harmful or offensive.

We reserve the right to remove content that violates these Terms or applicable law, and to suspend or terminate accounts in the event of repeated or serious violations.

8. Face Recognition and Biometric Data

LoveLensGallery offers an optional face-recognition feature that analyses uploaded photos to generate face embeddings - numerical representations of detected facial geometry. This feature allows the event organiser to filter the gallery by person.

Face embeddings constitute biometric data and are classified as special-category personal data under GDPR Article 9. This processing is performed only upon explicit activation of the feature by the registered user (the event organiser), and only for photos uploaded to their specific event.

Face embeddings are stored securely in our database and are used exclusively to group and filter photos within your private gallery. They are not shared with any third party, not used for any identification purpose beyond your gallery, and are permanently deleted when you delete your event or your account.

Wedding guests whose faces appear in uploaded photos are informed of this processing via a notice displayed on the upload page. Any guest may request deletion of their face data by contacting contact@lovelensgallery.com.

9. Guest Uploads

Wedding guests may upload photos and videos by scanning your event QR code without creating an account. Before uploading, guests are shown a summary of applicable terms and a privacy notice. By uploading, guests confirm they have the right to share the content and that it does not infringe any third-party rights.

As the event organiser, you are responsible for informing your guests that the QR code enables photo and video sharing and that uploaded content may be subject to face-recognition processing if you have enabled that feature.

10. Prohibited Uses

You may not use LoveLensGallery to:

Upload content that infringes copyright, trademark, or other intellectual property rights of third parties.
Upload content that is illegal, defamatory, obscene, or harmful to minors.
Attempt to gain unauthorised access to other users' galleries or our systems.
Use automated tools to scrape, harvest, or otherwise extract data from the Service.
Resell, sublicence, or otherwise commercialise the Service without our prior written consent.
Use the Service for any unlawful purpose or in violation of applicable regulations.

11. Intellectual Property

All software, platform design, trademarks, logos, and other intellectual property relating to LoveLensGallery are owned by IMGUPSCL SOFTWARE SRL. You may not copy, reproduce, modify, or create derivative works from our platform without prior written permission.

12. Service Availability

We strive to provide reliable and continuous access to the Service, but we do not guarantee uninterrupted availability. We may perform scheduled or emergency maintenance that results in temporary downtime. We will not be liable for losses arising from service unavailability.

13. Limitation of Liability

To the maximum extent permitted by applicable law, IMGUPSCL SOFTWARE SRL shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data, loss of revenue, or loss of business opportunity.

Our total liability to you for any claim arising under these Terms shall not exceed the total amount paid by you to us in the 12 months preceding the claim.

14. Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (GDPR). Please read our Privacy Policy for full details on how we collect, use, and protect your personal data and your rights in relation to it.

15. Modifications to These Terms

We may update these Terms from time to time. We will notify registered users by email of any material changes at least 14 days before they take effect. Continued use of the Service after the effective date of updated Terms constitutes your acceptance of those changes.

16. Governing Law and Dispute Resolution

These Terms are governed by Romanian law and applicable European Union regulations. Any disputes that cannot be resolved amicably shall be subject to the jurisdiction of the competent courts of Romania.

EU consumers also have the right to use the European Online Dispute Resolution platform, accessible at https://ec.europa.eu/consumers/odr.
